An attorney I know puts it this way:"Twitter is a private platform not owned or controlled by the government. Therefore, Trump has this backward: Twitter’s flag on Trump’s tweets is itself protected under the First Amendment. In addition, Twitter’s flag is protected speech, because it is demonstrably true." His "executive order" which would punish social media companies like Twitter for fact-checking or otherwise calling out Trump's falsity, is unlikely to pass Constitutional muster for this reason. |
