This is especially true for Black defendants.It's also one very good reason why the Black incarceration rate is so artificially high. Just the threat of terrifyingly long prison sentences for losing at trial is one reason why so many people--even those who couldn't possibly have committed the crime they were charged with--plead to a lesser offense. It's not quite as cut-and-dry as you think. |
