Maybe as a policy matter, but not a Constitutional one. There should not be a "Living Constitution" that a majority of Justices can subvert when the clear text does not support their policy aim. The Constitution makes no difference between those who are here legally and those who are not for purposes of counting in the census. As this question will result in the deliberate undercounting of those who the Constitution says must be counted is unconstitutional. |
