If they do they'll find the numerous cases where equivalence between state run and Fed run exchanges is clearly specified. There is only a single instance, which initiated this suit, where it is not.Plus, I don't believe the IRS is allowed to apply any law on a state by state basis. Since the court has acknowledged the legitimate power of the IRS to collect taxes related to the law, same would apply to granting credits as specified. |
