I don't feel bad for the Cadillac guy, damn rich people. Most likely his fault for crashing. He won't be showing off his rich car for awhile, and its going to cost him a lot to fix it. Good for him.As for the bus, it looks repairable. Nothing to crazy. I hope the B/O and passengers okay soon. |

Good for him.Under collision coverage, insurance companies are not obligated to pay to fix or replace a covered vehicle when the driver rear-ends a stopped vehicle (hit while legally parked or hit while stopped at a red light.) and the driver of the other vehicle was not issued a summons or arrested in connection with the accident. It goes by percentage of "at-fault" in terms of how and why this accident happened - - zero percent liability for NYC Transit and 100 percent liability for the Escalade driver. Plus the insurance company may not renew his coverage once it expires. And don't forget if the SUV was under a reported bank loan, that means the driver loses his car AND still has to pay off his car loan because the insurance company (as the loss payee) will not pay a penny for the actual cash value of the car. |

I believe you are mistaken. If the driver of the (presumably at-fault) Escalade has Collision coverage then he will be covered for the damage to his own vehicle, less the deductible.If he only has liability coverage, then he will not have coverage for his vehicle -- only for the damage he did to the bus, and potentially for the injured. Collision coverage will generally pay as long as the damage was not intentional. Poor driving skills do not get the insurer out of paying the claim -- they are supposed to underwrite and price for that risk. |

I was rear ended in Manhattan stopped at a red traffic light on 56th street about a month ago in a 1 year old Mini with full coverage struck by an SUV at low speeds. Although the damage was no where near the Escalade's, the driver admitted guilt on the accident report, in part because his license plate broke off after riding up my bumper into the tailgate which I pointed out the mounting bolt scratches in my bumper skin and handing the cop the plate. Although I filed a claim with my own insurance to start the repairs after waiting almost 4 days to hear from the drivers insurance company, my body shop received his check and I did not have to use mine. I'd guess he was 100% responsible due to admission on the report but I can't see how a parked car can not get fixed by the culprit's insurance who hits it assuming there is a accident report. |

You run into a light pole. It wasn't the light pole's fault. Your liability coverage pays for property damage to the pole. Your collision pays for damage to your auto.If you run into a stopped vehicle, the police are going to be hard pressed to give a ticket to the driver of the stopped vehicle. Your liability coverage pays for property damage to other vehicle (hopefully not bodily injury for the other driver, but that's what it's for). Your collision pays for damage to your vehicle. If your vehicle is totalled you get a check (less than replacement); if you're upside-down on the loan, you probably should have had "gap" insurance. Leased vehicles usually include this as part of the payment. |

Insurance policies in NY State can only be cancelled (after 60 days into the policy) for non-payment, license suspension/revocation, or fraud by the policyholder.Otherwise, the insurance company will simply do a non-renewal - - they will mail a 45 day notice of their intent to not renew your insurance coverage once it expires. |
