He won't be showing off his rich car for awhile, and its going to cost him a lot to fix it. Good for him.Under collision coverage, insurance companies are not obligated to pay to fix or replace a covered vehicle when the driver rear-ends a stopped vehicle (hit while legally parked or hit while stopped at a red light.) and the driver of the other vehicle was not issued a summons or arrested in connection with the accident. It goes by percentage of "at-fault" in terms of how and why this accident happened - - zero percent liability for NYC Transit and 100 percent liability for the Escalade driver. Plus the insurance company may not renew his coverage once it expires. And don't forget if the SUV was under a reported bank loan, that means the driver loses his car AND still has to pay off his car loan because the insurance company (as the loss payee) will not pay a penny for the actual cash value of the car. |
