But the years of litigation that followed related to the value of the property seized by the City, and due to be paid to to the former owners. The question as to the legitimacy of the seizure was not an issue; the doctrine of eminent domain was not seriously questioned. Perhaps it might have been used as an excuse, but litigation between the City (not MaBSTOA itself) and the former owners should not have been a basis for MaBSTOA's internal management.
