I forget which station, but he'd gotten drunk, fell off the platform, and part of him met the business end of an N train (if I'm recalling right)There was another one, similar, but several years before that that reached verdict just about the same time. Another drunk, fell off the platform, and received the amputation courtesy of NYCT. The issues in that one were the slow speed of the train and multiple witnesses who said that the train could have stopped but didn't. Jury found something like 65/35 liability split but they were both multimillion dollar verdicts. Both on appeal now, as I recall. There's a decent chance that the second one will be reversed, I think, for technical reasons. Not sure about the first. |

Limb amputatuion is not an acceptable judicial punishment for what is, I must admit, a minor crime.But if it happens to you while you are committing what anyone should know is an illegal at, you should not be rewarded in the slightest. He should definitely be charged with tresppassing and/or vandalism. The TA can even use the fact that he was committing an illegal act to hopefully, lower their financial liability. |

Were this behavior to continue, then yes, there is nothing else to be done but to jail the individual.The LION does not think that a fine will deter this kind of behavior. What are we to do, wait until he repeats enough times to qualify for jail time? LION doesn't think so. LION *would* like to bring back Corporal Punishment. The miscreant should be caned for an offense like this. As a punishment, caning would have to be ordered as a punishment by a judge after a trial and conviction.
