What ever happened with the graffiting 13 year old that was killed by the LIRR train. Did the LIRR settle out of court, or was their a lawsuit?

That is an even better reason to use correct grammar - ''Graffiti Teen' Hit by Train' would have been more concise.L

True, but hit by train could mean commuter rail or freight. Subway defines which type of train. Maybe that was their point.

I forget which station, but he'd gotten drunk, fell off the platform, and part of him met the business end of an N train (if I'm recalling right)

There was another one, similar, but several years before that that reached verdict just about the same time. Another drunk, fell off the platform, and received the amputation courtesy of NYCT. The issues in that one were the slow speed of the train and multiple witnesses who said that the train could have stopped but didn't.

Jury found something like 65/35 liability split but they were both multimillion dollar verdicts. Both on appeal now, as I recall. There's a decent chance that the second one will be reversed, I think, for technical reasons. Not sure about the first.

Remember that the liability findings are premised on 'could've stopped, should've stopped, didn't stop'. I think that NYCT's legal team didn't do too well.

Limb amputatuion is not an acceptable judicial punishment for what is, I must admit, a minor crime.

But if it happens to you while you are committing what anyone should know is an illegal at, you should not be rewarded in the slightest. He should definitely be charged with tresppassing and/or vandalism. The TA can even use the fact that he was committing an illegal act to hopefully, lower their financial liability.

Why are you repainting fire hydrants? Do you know what a pain in the ass it is to remove a cap which has been painted on? I don't care if it's graffiti or some person with good intentions, but a fire hydrant with its port cap locked on with paint could waste precious minutes during a fire.

Actually, you generally can't win a completely baseless claim. Sure, it's not quite as drastic in this case, but if you're robbing a house and get injured in the process, you can't sue the owner. That's a pretty firmly established principle.

He did not receive any punishment.

The loss of his leg is not punishment. Punishments are meted out by a judge. He has not (AFIK) even been charged with anything yet let alone appearing before a judge.

He SHOULD be charged and tried for trespassing and vandalism, and a judge will then determine a penalty or punishment, and he may at that time take into account the loss of the man's leg.

He lost his leg as a result of his own stupidity and carelessness. That is not the affair of the MTA, NYC, or the judicial system.

The LION does NOT believe that a jail sentence is appropriate for this sort of vandalism. Were this behavior to continue, then yes, there is nothing else to be done but to jail the individual.

The LION does not think that a fine will deter this kind of behavior.

What are we to do, wait until he repeats enough times to qualify for jail time? LION doesn't think so.

LION *would* like to bring back Corporal Punishment. The miscreant should be caned for an offense like this. As a punishment, caning would have to be ordered as a punishment by a judge after a trial and conviction. It would have to be carried out by a skilled officer. This will make an impression on a kid. Jails and Fines do not.
