That to me is the real issue here. |

I doubt the soldiers are trained in MTA photography policies since the cops obviously aren't. However the cops should know by now that photography is legal on MTA property. We all know people with faces like that. The kind that one would cast as "The Criminal" if making a movie. |

The only reason that I can think of on why Nilet was stopped and was told that it is illegal for photos is because he may have been in an area where it was not open to the public. From the looks of the pics, the area was not open to the public at that given time they were taken. If the platform was open to the public at the time, then he may have had no problems with taking the photos. I still say that his approach to the employees and authorities was improper. No, all of the platforms are open all of the time unless specifically closed off. And I don't think I've ever seen any specifically closed off. That's not why he was stopped. As far as illegal photos at GCT, my higher up says you can't. Told you already, your source is wrong. Photos at GCT are legal. And BTW: What you gave me is regarding LIRR except for the bottom part of the page which I could have used when I had my altercation on the 55 Ave Overpass. No, the entire thing is for MNCR too. And it proves your source wrong. |

Last Saturday I went on the ERA's GCT Tour. I asked two GCT reps about taking pictures at GCT. I was told by both of them that taking pictures on the platforms at GCT was not allowed. I did ask about taking photos at other stations and I was told that there is no problem with photography at other stations. My advice is if you want to take pics at GCT take one or two and leave. It might have been a better idea to apologize to the MTA guys and leave right then. That way you may have avoided the hassles later on. Good luck and keep us posted. |

Posted by HarryP on Thu Feb 21 07:23:12 2008, in response to ROBBED BY A COP— AGAIN!, posted by Nilet on Wed Feb 20 20:45:31 2008. This is a total outrage! What is going on in this so-called "Land of the Free"???1. First of all, if you were in an area open to the public and not violating any other law, you were not trespassing. 2. If your property was seized w/o probable cause, you were a victim of a crime, and you should file a complaint with the District Attorney's Office in New York County. 3. Most important, there is a memo dated March 16, 2006, from MTA Police Chief Kevin J. McConville, stating: "There are no rules prohibiting the photography of Long Island, Metro-North or Staten Island trains and/or stations. Members should only be concerned if the subject(s) taking photographs are trespassing on railroad property not otherwise open to the public, or are endangering either themselves or others by their actions (e.g., stepping onto active railroad tracks). "Accordingly, please remind members of your commands that there is no ban in effect relating to photography of the railroads." You can get a copy of this memo by going to Railroad.Net, MetroNorth message board. This should be carried with you at all times. As for photography on the platforms or other public areas of Grand Central Station being illegal, this is a bunch of b.s.! Also, I would seriously consider taking this entire incident to the media, but first consult with your attorney. Do not be deterred by certain members of this message board. Pursue your legal rights guaranteed under the U.S. constitution! Good luck! |
