I'd often say that these cars are in worse shape than the R36s underwater! At least they are serving some purpose in the ocean as reefs, while the other R36s are doing nothing but collecting rust. |

That's the one, if I'm not mistaken.To make a long story short, NJ's Department of Environmental Protection launced this 8-year program/study to see how the asbestos will affect sealife...despite the fact that lots of other studies concluded that asbestos does not harm if its underwater. So what does that mean for the rest of the redbirds rusting away? After some crews at Unionport Yard took the time to save redbirds of each class - hence, the Unionport Redbirds - the litigation was launched and the cars have been sitting there almost 5 years now. Maybe the R36 cars are part of that litigation too, because they've been sitting at Unionport since 2004, while occasionally moving the rail adheson car to and from Westchester Yard, and they've not been restored either. That may also go for the R36 ML cars 9542-43, which were briefly at the Transit Museum before being removed. |

From what I know, not much is said about the litigation, but the then Governor of NJ DiFrancesco claimed the MTA kept disposing the Redbirds into the Atlantic knowing that the cars contained asbestos. Most of the stuff was kept between layers of epoxy that was kept within the walls inside the car bodies.So the litigation is, IIRC, that until NJDEP concludes its 8 year study, MTA can't dump more cars into the sea, and moreover, do amything much with the remaining Redbirds (Ex: no fan trips, no restorations, etc). Of course the cars sitting at Unionport can be moved around...but that would apply if they are doing something "work service-related". (Ex: moving work cars between yards). |

Even though I said they were taken out of the Transit Museum, they are actually, last I heard (at least when I was at the museum last year), outside the museum, sitting on the BMT/IND side of the tunnel past the switches.Last I saw them, I remember seeing, in the interior where the car numbers are, near the Emergency Brake, was some piece of masking tape under the car number and written on it in red marker "Museum Car". |
