Here was my scenario, but since the girls involved were white it didn't make national news:1. Two girls are kicked out of a closed car by the conductor. They proceed to sit in the otherwise silent car I am in and play loud videos. 2. Annoyed, I state loudly "they're called headphones." 3. They respond with "this isn't the quiet car!" (since the only other open car had basically a frat party going on, this was the the quietest it was going to get). 4. I respond with "Most people already know it's rude to play sound in public, at least those not raised by wolves." Blissful silence. Sometimes saying something with not-very-subtle insult is needed (not to the level of the ass in the original video of course). Also, I'd like to point out how many arguments occur due to corralling people into as few cars as possible, and reiterate my desire for the frequent, fully open trains that eliminating on board fare collection and going to turnstiles/validators would provide. Dude in the other video would have been able to get off and wait for the next one if they weren't every hour and didn't require a new ticket. |

The reason for wanting to see the entire video is that what was available is insufficient to conclude that the man shown, however rude he might have been, did not do anything unlawful. The crimes charged, menacing in an unspecified degree (see Penal Law §§ 120.13, 120.14, 120.15, and aggravated harassment in the second degree (see Penal Law § 240.30), both require a threat of physical harm. In the available video, the man is shown giving his opinion as to the character and the legitimacy of the other passengers (referring to them as "monkeys" and as having unknown parentage), all of which is protected (even though offensive) speech. It is not a crime to hate someone. The linked report did state that the man said, "I’ll smack the [expletive] out of you," which could be construed as a physical threat. However, I would want to see the full context to determine if it were, in fact, a legitimate threat of physical harm, or if were mere smack talk that no reasonable person would believe to be an actual physical threat. The desire to see the full video here has nothing to do with the color of either party to the incident, but rather a desire to decide based on the facts and the law rather than emotion alone. |

We'll see how this plays out before the bar. However, the phrase "we need to see the whole video", or "we don't know what happened before the video starts", have commonly been used to give white suspects the benefit of the doubt. No such concession is ever made, when Black suspects are the object of such filming. This isn't a jab at anything, it is sober fact. |

It'd would be an astonishing and insincere interpretation to claim that those words don't mean what they mean from someone who has gone on an angry an emotional tirade for several minutes.Just like party B doesn't get to behave like...animals...party A doesn't get to behave like an animal just because he's offended. Everyone in society is responsible for keeping themselves in check. Who knows if it can be proven and convicted it might help dissuade this "culture of violence" I keep hearing about. Or you know we can just go on and pretend it isn't what it is. |

I think those words could be used either way: as a legitimate and credible threat of physical harm, or as an expression designed to show contempt for another person that would not be reasonably interpreted as a physical threat. We have seen President Trump and Vice President Biden both "threatening" to beat up each other, but I don't think anyone seriously believed that either was actually making a threat of physical harm. This is why video showing the context would be especially helpful. And ultimately it is a jury question, the meaning of the words to be judged by twelve reasonable people from the community.Given what I have seen in the video, this man was rather agitated, animated, and without doubt crude--a great deal of emotion being exhibited--but also having controlled his physical posture. I am not certain how I would come down on the matter. |
