Of 222. That means there are 140 that have not yet been in the SMS program but still out there somewhere. 74 R-32's that have completed SMS. Of 222. It must have been sitting up in the pocket for a while; the day was hot in the 80s and the train came in with frosted/fogged up windows. A few years back, Kawasaki was dedicating it's new plant in Lincoln, Nebraska. In attendance was the very popular and extremely likable Senior VP of Subways (at that time). During the dedication, he made a speech in which he touted the unequaled quality of the Kawasaki Product (or words to that extent). That comment was featured in A full page article in one of the NY News Papers. Unfortunately, IIRC they were bidding on the R-160 contract at the time and that comment brought about the threat of a law suit because since that senior VP was part of the selection process, the other vendors felt that they were not playing on a level playing field. While I will not get into the specifics of the current ethics mess, I think that several of the unsuccessful bidders might have a supportable claim in court. |

I can see where "unequaled" could cause some consternation, but it's not an ethics violation unless there is something more than that. Besides there's no ethical requirement that the people that award contracts have the same opinion of all of the bidders going into the process. |

There has got to be the appearance of fairness in the bidding process. NYCT does not have to accept the low bidder for a contract - especially new car procurement. That said, the mentioned incident and another some time earlier, might have led to his premature departure.All this aside, the issue that I refer to now (related to the R-179s) is indeed a possible ethics violation that did appear in an article in the Daily News. I just wonder if the legal ramifications of that incident have led to the current delay. |

Here's the OIG report for more on this whole saga. The report has a date of March 2012 - it looks like the investigation was buttoned up first, before giving the contract to Bombardier. The other guys wouldn't have known about it until then, so I agree that the protest is more than likely due to this issue. |
