It seems to me that the concept of "following orders" as a defense for illegal behavior was addressed during the post WWII Nuremburg trials. If we allow police officers in so called civilized countries like the USA to successfully plead "following orders" as a defense, then we open the door to having to pardon all the Nazi war criminals who used that same defense. The severity of the offense is irrelevant since permitting the "following orders" defense for minor violations will ultimately encourage police and similar persons to engage in more serious acts of civil rights violations with disatrous results. |
