Whoops ... got that last sentence wrong ... said "defendants" meaning the photographers, but in an article 78, they'd be the plaintiffs. Bottom line is that all you have to do is demonstrate that the rules are one thing, they did the opposite, and in doing so exceeded their authority. An article 78 proceeding is not the same as a civil suit - an article 78 action COMPELS them to follow the rules ... article 78's usually work because "damages" are not part of the case ... |
