I'm not a lawyer, so take this advice for what it's worth ...

I would not mention your fear of being on a watch list as the reason that you failed to produce identification when requested by the officer - it sounds like you have something to hide. It's more reasonable that a person in your situation would be surprised by a demand for ID and hesitate if they were not engaged in wrongdoing.

Are there any restrictions posted by the MTA about photography? Anything at all that a passenger would be reasonably expected to see? Also, have you ever taken photos in the presence of other deputies or police and not been questioned? All of these could help establish your belief that you were not engaged in prohibited behavior.

Personally, I don't have a problem providing identification when requsted. I stay civil and I don't argue civil rights with an officer who clearly is misinformed and spouting make-believe post-9/11 laws. If I have a problem with what I'm being told to do, I would take it up later with the transit agency or the police department's headquarters.
