Their judgment must be "reasonable" and must include accounting for circumstances as well as what the law says.That said, there is an area of discretion and an area outside of it. My objection is when they go outside of it (which they are doing in many photography cases). It's primarily the fault of supervision and upper management of the department. I am rooting for the NYCLU to win the case. |
