TOUGH situation there, because with SEPTA scratching CSX' rails ... if there's ever a derailment there on CSX, it WILL be SEPTA who will be responsible for it if those scratches grow to a defect.

I just got this email from a 40-year railroader who's on my rail photo email list:
This is a very interesting track arrangement. It will be interesting to see how this works long term. An old MW trick for cutting rail is to repeatedly pound a chisel on the head of the rail. It will not take long for the rail to break vertically from head to base. I would think that over a period of time the repeated pounding of the trolley flanges on the CSX track would act the same as the chisel.
