I would think in this instance they would be able to get a waiver given the extreme circumstances that were involved (i.e.: A natural disaster). Especially if the old loop station has to be put back in service for two years or more as the (1) terminal due to the current station being unusable, I would also do the necessary ADA work while the station is open because that would also allow for a later re-working of the station for the Lexington line that was described previously.

That said, anyone who would cry foul over the MTA getting an ADA waiver to re-open old SF immediately for revenue service would be missing the reason it would be done: Hurricane Sandy effectively destroying the station that replaced it. This clearly would be an emergency circumstance.

The other option would be to see if it is more feasible (and cheaper) to simply extend the old station on each end enough to allow for 10 cars and do a full renovation of the old station, making it ADA accesible and abandoning the current station.
