That explanation would only make sense if they were defending an incident where someone was detained but ultimately not charged with anything. That is not the case here, so that is not what "King Bloomburg and his faithful "deputy" Ray Kelly" would say in this case. There is absolutely no defense possible that "King Bloomburg and his faithful "deputy" Ray Kelly" could use for the actions of these officers in charging Steve with a violation of 1050.9c when the law is the opposite of what the cops meant to charge him with.
