It will be in 29 days although there will be a proposition on the ballot to amend California's state constitution so that banning gay marriages would meet court requirements. Most are predicting that will pass, but there will likely be no overturning of any gay marriages that happen in the interim.

Portia DeRossi is really cute and Ellen DeGeneres has a nice ass and an OK face but the ass(es) we should be talking about are the asses in the California State Supreme Court.

First, let me say that I have nothing against gay marriage. I have nothing against same-sex marriage provided that they are legal in the state where they are done. The people of the state of California voted against Gay/Same-sex marriage, as I understand it. The state supreme court (lower case spelling is totally justified here) in california has said, the hell with the will of the people. They've said "of the people, by the people and for the people" is a meaningless phrase. They have, once again, legislated from the bench in direct opposition to the intent of the framers of our constitution. What they have done is wrong and should be immediately stopped by the electorate and the governor. Thankfully, it's in california and not in any normal state.

If that were the case - shouldn't all issues of constitutionality be decided by the US Supreme court. I don't believe that it would be a constitutional issue though since any authority not specifically given to the federal government, in the constitution, is an issue of State rights. Since the federal government has no constitutional right to regulate marriage, it is a state issue and should remain so.

How come in a government supposedly of "checks and balances", the Supreme Court is unchecked, and even state courts remain unchecked? There's way too much legislation from the bench, especially from the latter half of the 20th Century onwards. Very undemocratic, or so it appears to me.

Hardly. This isn't a black and white issue, the right of marriage appears in neither the U.S. or California State constitutions. It's all about interpretation, and the legal foundation of this decision is hardly worth overturning the will of the people.

That being said, I really don't care about gay marriage. What I don't like is a few judges overturning the will of the people. Very undemocratic.

All of the other states that have laws against gay marriage had to modify their state constitutions to do so. It sounds like that must be a requirement and California's Republican dominated supreme court was correct in their interpretation.

Yes, I agree with you. The judges only have say over California so it's the state constitution used here and not "unconstitutional" in the federal sense.

I agree that it's not black and white but the gay rights advocates argued that if a right to marry exists for heteros then it should be allowed for gays, much like was argued in the 1948 case involving interracial marriage. I agree that there is no written right to marry but I'm not sure the people can vote in discriminatory laws.
