More to the point, we spent upwards of a trillion dollars on Iraq and then again on Afghanistan. Just imagine what might happen if we spent that much money on America! The invasion and occupation of America will fail unless we, er, I mean our troops have intact roads and bridges, functioning electricity and communications, and water uncontaminated by industrial waste and fracking runoff. That's why the Army Corps of Engineers will need a trillion dollars of its own to reestablish the Civilian Conservation Corps and put people to work building infrastructure. Yep ... sadder still is that we took out Saddam (like we give a shit about Arabs in the first place) and handed Iraq over to Iran, lock stock and and U238. So after doing that, Ayaatollah gets to run around free and get ready to nuke Israel. But oh wait, it was a republican that did that so that's OK. Him, Cheney and his PNAC friends weren't happy stopping there though, next trick was whipping out that "Arab Spring" to ensure that the mayhem gets even further out of control. But nope, no problem, it was the republicans behind all that too and that's good somehow. :-\ |

They can, if the judge determines it's necessary to compel court appearances at a bail hearing in which they are afforded the opportunity to respond. However, jail is not the same thing as prison, and neither is the same thing as "indefinite" imprisonment in a concentration camp. A person who has been charged with a crime on the basis of probable cause and is awaiting trial can be locked up until the trial has concluded, under relatively exceptional circumstances, and with a guarantee that the duration of said confinement has an absolute maximum limit (that being the right to a speedy trial in that same amendment; if the prosecutors delay for too long, the charge can be thrown out on a speedy trial motion). This does not, in any way, justify the indefinite imprisonment of people who have not been charged with a crime, in the complete absence of even probable cause that any crime has even occurred, without any ability to challenge that imprisonment. |

I am not familiar with the particulars of the Gitmo situation. I agree that what they are doing is probably not consistent with past practice (existing law, etc.), but I also think that since the types of enemies of our country is experiencing (i.e. people clearly fighting "America" but not backed by an actual other sovereign nation) has changed, our laws need to change with it. However I think the changes in law should still reflect our values and be in line with our existing laws and practices as much as possible. I firmly believe in the whole Ben Franklin business. But if a guy like Obama doesn't even want to shut it down, and he LOVES America, then I think there must be some good reasons for it. I think the process should be more transparent and there should be laws made by publicly elected officials to deal with the situations that are causing these guys to be held indefinitely at Gitmo. |

It isn't about "someone changing planes at JFK", Canadian citizen or otherwise.Someone changing planes in JFK is what literally happened. It's about what they have done, or who they are involved with. OK, what did he do and who was he involved with? And how did it justify him being imprisoned and tortured? You like to make some seemingly innocent phrase such as "someone changing planes", trying to make a point using the innocent absurd, yet fail to engage that in the big picture. The big picture is this: The US government claims that it has the right to arrest/kidnap anyone from anywhere on the planet, and lock them up forever without any oversight and without offering them any recourse. You, me, your kids, politicians who oppose them— anyone. This is self-evidently wrong and I can't fathom how you could possibly be trying to justify it. The guy who was changing planes is one example of the United States invoking this policy to disastrous effect, included for the sake of putting a human face on the problem. It's the same reason why it wasn't about a "bacon cheeseburger" either. Dude, everybody already agreed it was about a bacon cheeseburger. Including yourself. |

Posted by Nilet on Tue Jun 3 09:19:32 2014, in response to Re: Obama Frees Five Prisoners From Gitmo!, posted by Terrapin Station on Tue Jun 3 08:53:07 2014. I am not familiar with the particulars of the Gitmo situation. Here they are: The US government arrests/kidnaps people. Some of them are US citizens. These people are locked up in Guantanamo Bay, without any charge being filed against them, nor any ability to challenge this imprisonment. The US government has now admitted that most of them were random people, completely innocent of any wrongdoing, but is claiming they can't be released because having been imprisoned and tortured for the last decade might motivate them to take highly justified revenge against the US for said imprisonment and torture. Essentially, "the fact that we wrongfully imprisoned you justifies imprisoning you." Note that additionally, some people were arrested, formally charged in courts, and then told that they would be locked up in Guantanamo forever unless they pled guilty in court and refused to present any evidence of their innocence. Still others were kidnapped, imprisoned in Guantanamo without charges or ability to challenge imprisonment, tortured, and then given a sham trial in a real court only after they had been too broken by torture to meaningfully defend themselves. ...but I also think that since the types of enemies of our country is experiencing (i.e. people clearly fighting "America" but not backed by an actual other sovereign nation) has changed, our laws need to change with it. Bullshit. There have always been criminals plotting mass murders; their motivations are irrelevant and their capabilities are unchanged. A "terrorist" group is no different from an organised crime family, which is no different from a "militia" that thinks the US is evil because black people. The only thing that distinguishes the arbitrary subset of brown-skinned criminals designated as "terrorists" is that they committed a crime more successful than most (courtesy of George W. Bush and his apparent illiteracy) and a group of unscrupulous politicians exploited that crime to seize dictatorial power by convincing a bunch of panicked animals that it was necessary to "protect" them. However I think the changes in law should still reflect our values and be in line with our existing laws and practices as much as possible. I firmly believe in the whole Ben Franklin business. Good. Then you support the immediate closure of Guantanamo (and other concentration camps), the cessation of mass spying, the repeal of the Patriot Act, NDAA, and Authorisation for Use of Military Force, and a massive investigation of the Bush and Obama regimes with plenty of special prosecutors to go around. But if a guy like Obama doesn't even want to shut it down, and he LOVES America, then I think there must be some good reasons for it. Objection! Assumes facts not in evidence. Seriously, Obama is either a far-right extremist or a spineless pile of jelly who acts like a far-right extremist because a far-right extremist told him to and he passively does whatever the shoutiest man in the room tells him to. "A prominent government official told me it was necessary, so I think there must be some good reasons for it" is the common bleat of the panicked animals who agreed to the end of democracy. I think the process should be more transparent and there should be laws made by publicly elected officials to deal with the situations that are causing these guys to be held indefinitely at Gitmo. The situation that is causing these guys to be held indefinitely is that the government has declared it can hold anyone indefinitely and doesn't have to provide a reason. Luckily, we already do have laws to deal with these situations— chief among them, the Sixth Amendment quoted earlier in this thread. |

You got pwned so hard that even though you are directly responding to me, you're still too scared to hit the "reply" button to my post so it looks like you're talking to yourself....it isn't worth my time trying to reason with you... That's your cute way of saying that you have no reason to think I'm wrong but you're not mature enough to admit that I'm right. ...and no everyone said it wasn't about a bacon cheeseburger... Nobody provided any reason why it wasn't about a bacon cheeseburger, so they implicitly admitted that it was. Except for AlM, who misunderstood the word "celebrate" and, when corrected, agreed his opposition was erroneous. ...nor is this about changing planes but have fun deflecting... No, it's about the fact that the US government claims that it has the right to arrest/kidnap anyone from anywhere on the planet, and lock them up forever without any oversight and without offering them any recourse. You, me, your kids, politicians who oppose them— anyone. This is self-evidently wrong and I can't fathom how you could possibly be trying to justify it. The guy who was changing planes is one example of the United States invoking this policy to disastrous effect, included for the sake of putting a human face on the problem. Incidentally, you claimed his/their imprisonment was "about what they have done, or who they are involved with." I asked you: "What did he do and who was he involved with? And how did it justify him being imprisoned and tortured?" Unfortunately, you deflected it with some random nonsense about changing planes. Luckily, I'm used to the sort of games you play— you state an incorrect position, support it with a few incoherent arguments, and when those arguments are trivially disproven you throw a tantrum and accuse the other person of "deflecting" and being "irrational" then run home screaming to your mommy and refuse to acknowledge anything they say for a few days or weeks (while making sure to insult them anytime you think it's "safe" to do so without them noticing). |

Yeah, you're really going to need to explain that. I'm not familiar with the inner workings of your fantasy world; do you believe that stating unorthodox opinions causes the spontaneous generation of a Gravity Modifier powerup? |

The closest any conservative can get to humour is basically just a fancy way of saying "anyone who disagrees with me is horrible or evil or should be killed." |

Despite having them imprisoned, the US appears to have no evidence that they were actually terrorists or that they ever did anything wrong, so what's wrong with letting them go? |
