Obama Frees Five Top Terrorists From Gitmo!

I have no problem with trading prisoners of war but freeing five of the top terrorists from Guantanamo is just absurd. How long did it take our forces to find and incarcerate these bastards? And now the great Obama is going to send them out into the free world to do what they do best and that is to maim, destroy and kill. First report was that the soldier was in good health. Now the report is that he was in ill health and that Obama had to circumvent the thirty day congressional notification. So says Susan Rice. More bullshit like the Benghazi cover up. I'm pretty sure I can find a few people to agree with me. Just my two cents for what it's worth.

I am certainly happy that the young soldier is alive and free. I believe that ono of our soldiers is worth any number of those imbeciles. HOWEVER, having said that, it's been a long standing US policy not to negotiate with terrorists. Hereafter, the US can never say that we will not negotiate with terrorists. Terrorists will be more inclined to take hostages. Does this actually make us safer?

Released were Mullah Mohammad Fazl, Mullah Norullah Noori, Abdul Haq Wasiq, Khairullah Khairkhwa and Mohammed Nabi Omari.

Fazl was the Taliban’s former deputy defense minister and is wanted by the United Nations for his role in massacres targeting Afghan’s Shi’ite Muslim population.

Noori was a senior Taliban military figure and, according to his Pentagon dossier, was asked personally in 1995 by Osama bin Laden to participate in an offensive against northern alliance warlord Rashid Dostum.

Omari held several military leadership posts for the Taliban and helped organize the al Qaeda/Taliban militias that fought against U.S. and coalition troops in the first year of the war, according to his Pentagon dossier.

I ask again, what were they convicted of? Not what were they accused of.

Dave personally masterminded the 9/11 attacks, paid for the attackers' training and plane tickets, and served as second in command to Osama bin Laden himself.

Since your argument seems to be that an accusation automatically proves guilt, that makes you just as bad as any of them.

Mullah Mohammad Fazl (Taliban army chief of staff): Fazl is “wanted by the UN for possible war crimes including the murder of thousands of Shiites.” Fazl “was associated with terrorist groups currently opposing U.S. and Coalition forces including al Qaeda, Islamic Movement of Uzbekistan (IMU), Hezb-e-Islami Gulbuddin (HIG), and an Anti-Coalition Militia group known as Harakat-i-Inqilab-i-Islami.” In addition to being one of the Taliban’s most experienced military commanders, Fazl worked closely with a top al Qaeda commander named Abdul Hadi al Iraqi, who headed al Qaeda’s main fighting unit in Afghanistan prior to 9/11 and is currently detained at Guantanamo.

Mullah Norullah Noori (senior Taliban military commander): Like Fazl, Noori is “wanted by the United Nations (UN) for possible war crimes including the murder of thousands of Shiite Muslims.” Beginning in the mid-1990s, Noori “fought alongside al Qaeda as a Taliban military general, against the Northern alliance.” He continued to work closely with al Qaeda in the years that followed.

Abdul Haq Wasiq (Taliban deputy minister of intelligence): Wasiq arranged for al Qaeda members to provide crucial intelligence training prior to 9/11. The training was headed by Hamza Zubayr, an al Qaeda instructor who was killed during the same September 2002 raid that netted Ramzi Binalshibh, the point man for the 9/11 operation. Wasiq “was central to the Taliban's efforts to form alliances with other Islamic fundamentalist groups to fight alongside the Taliban against U.S. and Coalition forces after the 11 September 2001 attacks,” according to a leaked JTF-GTMO threat assessment.

Khairullah Khairkhwa (Taliban governor of the Herat province and former interior minister): Khairkhwa was the governor of Afghanistan’s westernmost province prior to 9/11. In that capacity, he executed sensitive missions for Mullah Omar, including helping to broker a secret deal with the Iranians. For much of the pre-9/11 period, Iran and the Taliban were bitter foes. But a Taliban delegation that included Kharikhwa helped secure Iran’s support for the Taliban’s efforts against the American-led coalition in late 2001. JTF-GTMO found that Khairkhwa was likely a major drug trafficker and deeply in bed with al Qaeda. He allegedly oversaw one of Osama bin Laden’s training facilities in Herat.

Mohammed Nabi (senior Taliban figure and security official): Nabi “was a senior Taliban official who served in multiple leadership roles.” Nabi “had strong operational ties to Anti-Coalition Militia (ACM) groups including al Qaeda, the Taliban, the Haqqani Network, and the Hezb-e-Islami Gulbuddin (HIG), some of whom remain active in ACM activities.” Intelligence cited in the JTF-GTMO files indicates that Nabi held weekly meetings with al Qaeda operatives to coordinate attacks against U.S.-led forces.

Since you're so concerned with their not being charged by the U.S., feel free to let them stay with you.

Whether or not I believe in detention without charge or trial is irrelevant; in this case it's permissible by law.

Section 1201 of the National Defense Authorization Act (NDAA) for 2012 permits indefinite detention without trial of any person, including a U.S. citizen, "who was part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners."

A legal challenge against the Act failed. See Hedges v. Obama. In May 2012, a federal court in New York issued a preliminary injunction which temporarily blocked the indefinite detention powers of NDAA Section 1021(b)(2) on the grounds of unconstitutionality.

On October 2, 2012, the Second Circuit Court of Appeals ruled that the ban on indefinite detention would not go into effect until a decision on the Obama Administration's appeal had been rendered. SCOTUS refused on December 14, 2012, to lift the stay pending the appeal order issued by the U.S. Court of Appeals for the Second Circuit on October 2, 2012. The Second Circuit Court of Appeals overturned on July 17, 2013, the district court's ruling which struck down § 1021(b)(2) of NDAA as unconstitutional because the plaintiffs lacked legal standing to challenge it. The Supreme Court denied certiorari in an order issued April 28, 2014.

Thus far, it would appear I'm the only side of the argument; your last two posts contain 689 words between them, but you have had absolutely nothing to say on the subject.

The salient points are these:

1. You claim these five prisoners were "terrorists." How do you know that?

You have failed to provide any meaningful answer.

In service of finding an answer, I asked you two questions:

2. Do you understand the purpose of a trial?

You have failed to provide any meaningful answer to either question.

Since you seem to be under the impression that the nonsense you posted has any relevance to any of these points, let's take a closer look at it, shall we? You posted as much:

Section 1201 of the National Defense Authorization Act (NDAA) for 2012 permits indefinite detention without trial of any person, including a U.S. citizen, "who was part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners."


That is, it allows the detention of anyone who supported Al Qaeda. Since you donated half a million dollars to fund Al Qaeda training camps in Pakistan, that means you can be detained without trial. On the other hand, the five people released from Guantanamo have no connection to Al Qaeda of any sort, so there is no basis under the NDAA for detaining them. And if you disagree with either of these last two claims, I'd like you to think long and hard about what purpose a trial might serve before you go on another irrelevant tangent.

It's already been done, and the source is Forbes, YOUR choice source. My article is more recent than yours, so your old article is invalidated. Doesn't matter if I think the source is invalid, it's that you DO think it's valid that matters.

See, in the real world things change. It's not 1953 anymore. In fact it hasn't been for 61 years. Most doctors now see the benefits of ACA, and as the delivery models change from doctors having to handle their own administrative workload/expense to that work being handled by administrators for the group/medical home to focusing on patient care they are seeing the benefits of ACA for themselves, and its support is growing.

My father is a physician and supports the ACA more as the best option in a bunch of lousy options. He has seen a reduction in costs to the system because more patients are finally able to go see their primary care physician again and he is able to treat problems in a cost effective manner rather than them waiting until it is expensive to treat, showing up in the ER and the taxpayers footing the bill

An argument can be made that it might be better for US interests to keep hold of the 5 Taliban and let them kill the Sergeant if they feel like it. I wouldn't trust Olog to make such an argument, however.
