I didn't know that moving the date of the Presidential Inauguration had anything to do with a bar exam until I read the SubChat Code of Civil Procedure (after the fact of course). The judge also mentioned Tennessee v Scopes in dictum What can I say? My parents were right. I should have studied harder. Now I'm a washout. |

The judge is there to see that the jury rules solely on the evidence. Juries do occasionally acquit when a person is guilty but the circumstances are exceptional. That is known as "Jury Nullification" but that is a one time thing and does not set precedent. I guess that makes you wrong again - doesn't it? |

The judge is there as moderator for the proceedings. They ensure the rules are followed. If a jury decides (turns out in Florida a prosecutor and/or a jury can find a verdict on a lesser charge without it being officially charged to begin with....Selkirk looked it up). The entire point of a jury is to render a verdict. If they find something nobody thought up and it survives appeal....that's a precedent setting. From there, it becomes established law as it is used in subsequent decisions.So this jury could find, based on the fact that Zimmerman was pursuing Mr Martin, that he had no "ground" yet Mr Martin, who was rightfully and peaceably there did and return with a manslaughter conviction. You're assuming he's not guilty. He killed Trayvon Martin, an unarmed young man. The question is entirely the degree of criminality. I do not assume he's not guilty, there's proof of criminality. Zimmerman's own words speak of profiling. Do you think vigilantes deserve to walk whenever they kill? |

The judge is the trier of law. Any sort of legal opinion that might be precedential is issued by the judge. And even then, trial court proceedings aren't precedential except before the same judge (because the judge is probably going to rule again the same way given the same situation). Precedential value is only attached to appellate rulings in the same jurisdiction. |
