An agency of a state is empowered by the legislature of that state to function without further intervention of the legislature. Any of its actions are effectively actions of the legislature of that state. In this case it's two states, but the same thing applies.


Yes, but no laws are being made barring the practice by someone. The government can't control what the tenets of a religion are, and again, it's not the government's control if some tenets of some religion have a problem with something.

People are being excluded IF THEIR RELIGION MAKES IT SO THEY CAN'T PRAY IN FRONT OF A CROSS.

Then don't pray in that location. It's not the government saying you can't pray there. Do it in another location away from a cross. If St James Church with a big cross in front of it stood right across from the WTC and somehow didn't get destroyed on 911, and it was standing there over one of the fountains, it would be no different of a tenent that you couldn't pray there, so you would have to move to another spot out of view of it I supposed. Also not the government's issue.
