Funny you menion that. Most Rabbinic sources agree that the Torah never intended this literally, i.e., that someone's eye be gouged out in exchange for the loss of another's eye. Rather, the Torah meant that the tortfeasor was to pay a penalty in an amount decided by Moses and/or other judges to compensate the victim for the loss of the eye. The same system in use today in civil tort law.
