IX.Not that this proves that healthcare is a right, but it means that the Bill of Rights (or the rest of the Constitution, for that matter) is not at all intended to be an exhaustive list of all human rights. As for how healthcare could be construed as a human right: [T]hat all men are . . . endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men . . . it is the Right of the People to . . . institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.Declaration of Independence [emphasis added]. I know that I hacked that to pieces, but it goes to the argument that people have an INHERENT right to life, and to safety, and that governments are instituted in order to effect* same. It's rather short-sighted to assume that people can form a government that guarantees their safety against other humans, but not against diseases and maladies. You, of all people like to claim that the actions of humans are part of their nature, so why then do you draw a distinction against protection of life against non-human natural forces and that such protection extends only to violence of other humans? *For the benefit of some people with poor vocabulary, I must indicate that I do mean "effect," not "affect." |
