The only precedent is for subpoenaing documents and tape recordings (Nixon), but different legal standards apply for a subpoena seeking a witness’s live testimony before a grand jury.In 2000 the Office of Legal Counsel drafted a memo stating the Justice Department’s view that the text of the Constitution does not give the president express immunity from prosecution but that the powers of the presidency are so vast and important as to bar the indictment of a sitting president. But this is a memo, not law, so at the end of the day it's just an opinion. |
