1. Legally that is not necessarily Murder based on how the statute is written
2. Yes, but that is irrelevant to the question of whether he did or did not commit the crime charged
3. First part I agree with, but there was reasonable doubt on the second two clauses

Personally I think they would have stood a better chance charging Aggravated Battery which is the same level of felony as what was charged but fit the facts better
