I'm too lazy to figure out what his logical fallacy is with respect to religious people not being in jail.

Let's assume (for the sake of argument) he's right that people who regularly attend church are underrepresented in our jails.

That doesn't mean you could reduce crime by encouraging attendance at church. Maybe (probably) it's only the people who actively want to attend church even when there is no encouragement who tend not to commit crimes*. If you encouraged people of a criminal mind to attend church, they would probably be just as criminal. They'd just devote their energy to figuring out how to rob the collection basket.

* People who want to attend church tend to have regular lives. People with regular lives tend not to commit crimes.
