The problem is Oregon's state laws afford LGBT citizens the same rights against discrimination as race, gender, religion, etc. As that is technically a state matter based on Federalism and the state law expands upon what has been provided by the 14th Amendment it is constitutional. That being said, Oregon could enact a law that removes sexual orientation from race, gender, religion, etc. so that it mirrors Federal law |
