The jury cannot return guilty verdicts on lesser included offenses like manslaughter. The only count they went to trial on was the 2nd Degree Murder. Some states allow lesser included offenses to be considered if Defense counsel consents to it. Not sure about Florida, but his attorneys would have to be nuts to permit a jury to consider less included offenses in this case |
