[You know that for a fact that he knew about the B64 all along?]- Courts have ruled that being in a position to know is legally equivalent to actual knowledge. (Hence the frequent courtroom argument that somebody "knew or should have known" something.) - EVERY elected official in every city district was in a position to know the MTA's service reduction plan when it was first issued, because every elected official has staffers who are paid to know such things. Plus, EVERY State Senator and Assembly Member knew beforehand that service cuts would be necessary because they themselves had just voted to cut the MTA's funding. - Therefore, Assemblyman Colton knew. Period. |
